Instagram Privacy Notice

This Notice is issued by Vyntra Studio LLP, a limited liability partnership incorporated in India, having its registered office at 701-2, Everest Onyx, BSD Indraprasth, Inox Road, T.B. Sanatorium, Vadodara 390021, Gujarat, India ("Vyntra Studio", "we", "us" or "our"). It explains how we process personal data when you interact with our Instagram accounts, @vyntrastudiollp and @studioiambvr, by commenting on our posts to request a link (the "Service").

This Notice is published in accordance with the Digital Personal Data Protection Act, 2023 (the "DPDP Act"), the Information Technology Act, 2000 and the rules made under them. For the purposes of the DPDP Act, Vyntra Studio is the Data Fiduciary in respect of the personal data described below. Use of any of our products to which a link leads, including OSMosis and Normhawk, is governed by the privacy notice of that product.

1. Personal data we receive

1.1 When you comment on one of our Instagram posts with a keyword requesting a link, we receive from Instagram: the identifier and text of your comment, your Instagram-scoped user identifier and username, the identifier of the post on which you commented and the time of the comment.

1.2 We record whether and when we replied to your comment and the outcome of that reply.

1.3 We do not receive or access your password, profile details, followers, contacts, other comments or other messages, and we do not read the contents of your inbox.

2. Purpose and grounds of processing

2.1 We process this data on the basis of your request, made by commenting the keyword, and only for the following purposes:

• (a) to send you, once, the link you requested by a direct message in reply to your comment;
• (b) where applicable, to post a short public reply to your comment informing you that the link has been sent; and
• (c) to ensure that each comment receives no more than one reply and that our replies comply with Instagram's rules.

2.2 We do not sell this data, do not use it for advertising or profiling, do not add you to any mailing list and do not send you further messages unless you write to us.

3. Disclosure

3.1 This data is processed on our own servers, located in India, which are operated by a cloud hosting provider acting as our data processor. Replies are delivered through Instagram, operated by Meta Platforms, Inc., under its own terms and privacy policy.

3.2 We may also disclose personal data where required by applicable law, by order of a court or competent authority, or to protect the rights, property or safety of Vyntra Studio, our users or the public.

4. Retention

4.1 The data described in clause 1 is retained for no longer than ninety (90) days from the date of the comment, after which it is automatically deleted.

4.2 If we decide not to reply to an account (for example because it appears to be automated, or because Instagram cannot deliver our messages to it), we keep only that account's username on a do-not-reply list, so that it is not contacted again. It stays on the list until it is removed; you may ask us to remove it at any time, as described in clause 5.2.

5. Your rights and deletion of your data

5.1 Subject to the DPDP Act, you have the right to obtain a summary of the personal data we process about you, to request its correction or erasure, to withdraw your consent and to have your grievances redressed.

5.2 To have your data deleted before the end of the retention period, send a direct message to the account on whose post you commented or write to info@vyntrastudio.com, stating your Instagram username. We will delete the data within thirty (30) days and confirm when this has been done.

5.3 You may also delete your comment at any time on Instagram, and you may remove our access in your Instagram settings under Apps and websites.

5.4 If you are located in a jurisdiction whose data protection laws grant you further rights, such as the European Union or the United Kingdom, you may exercise those rights by writing to us at the same address.

6. Children

6.1 The Service is not directed to persons under eighteen (18) years of age. If we learn that we have received data of such a person, we will delete it.

7. Grievance Officer

7.1 Any grievance relating to the processing of your personal data may be addressed to our Grievance Officer, Ms Bhairavi Dave, Designated Partner, Vyntra Studio LLP, at the address in clause 9.1 or by e-mail to bhairavi@vyntrastudio.com. We will acknowledge it within forty-eight (48) hours of receipt and resolve it within one (1) month of receipt, or within such longer period as applicable law may permit.

8. Changes to this Notice

8.1 We may amend this Notice from time to time. The amended Notice takes effect when published on this page, with a revised "Last updated" date.
